What are VOCs, and why the big fuss?

Volatile Organic Compounds (VOCs) are found in everything from paints and coatings to underarm deodorant and cleaning fluids. VOC's have been found to be a major contributing factor to ground-level ozone, a common air pollutant which has been proven to be a public health hazard.

Who is impacted by VOC Regulations?

Currently, California, OTC states and MRPO states have enacted VOC limits for various car care products.

What is the OTC?

The Ozone Transport Commission (OTC) is a multi-state organization created under the Clean Air Act. The OTC is comprised of Connecticut, Delaware, District of Columbia, Maine, Maryland, Massachusetts, New Hampshire, New Jersey, New York, Pennsylvania, Rhode Island, Vermont and Virginia. All states enact legislation independently from each other. As a result of this, some OTC states have already adopted the VOC regulations in 2005, some in 2007.

What is MRPO?

The Midwest Regional Planning Organization (MRPO) is a multi-state organization made up of Michigan, Ohio, Indiana, Wisconsin and Illinois. Michigan and Ohio adopted the VOC regulations on January 1, 2009. Illinois joined them on July 1, 2009 and Indiana is scheduled to follow some time in 2009. Wisconsin has not set a date yet.

What products are impacted?

The majority of car care product categories are covered, including; adhesives, air fresheners, brake cleaners, waxes, polishes, compounds, windshield washer fluids, bug & tar removers, carburetor / fuel injection cleaners, carpet & upholstery cleaners, engine degreasers, fabric protectors, GP cleaners, GP degreasers, glass cleaners, hand cleaners, metal polishes, rubber & vinyl protectants (dressings), spot removers and under coatings.

When are the VOC regulations active?

California introduced VOC regulations in 1991, and has added additional product categories in the ensuing years. OTC and MRPO have followed California on regulation to date or have proposed laws waiting for effectively.

Can I still use my inventory after the cutoff date?

Yes, provided that the non-VOC compliant product was produced prior the date VOC regulations become active. These products can be sold and used for a period of 3 years. Any non-VOC compliant product produced after the cutoff date can not legally be sold or used in the states that have enacted VOC regulations. Check with your local Malco Distributor if you have any questions concerning product date codes.

What if I use non-VOC compliant products?

Companies selling non-VOC compliant products and shops caught using non-VOC compliant products face fines of up to $50,000 per day of non-compliance per offense. On March 29, 2004, the California Air Resource Board collected fines of $154,000 for air quality violations, including $12,500 from Joe's Muffler and Brake in Los Angeles for installing non-compliant catalytic converters on 86 cars. In addition to the fine, the owner was also placed on probation for three years.

Who enforces VOC compliance?

It is up to each state to enforce the VOC regulations, and the responsibility typically falls on the environmental department.

What is Malco doing to stay in compliance?

Malco is committed to offering our customers a full line of automotive products. Malco has been hard at work for several years on product formulations. Some products have been slightly modified to bring them into VOC compliance. Other brand new products such as Prizm Orange Hand Cleaner and Aqua Bead Silicone Suspension Dressing have been created and added to the Malco line. All new products in VOC regulated categories will be VOC compliant.

Will these regulations ease or go away?

It appears that these regulations are here to stay. California is the lead state in environmental issues, and they are covering additional product categories every year.

I don't live in an impacted state. Am I safe?

Yes, for the time being. You are free to use whatever products you wish. However, California's environmental actions typically are adopted by the rest of the country, and Malco expects all 50 states to eventually follow California's lead. The federal government currently has proposed regulation that would cover all 50 states. No date has been set at this time.
